Terms of Use

By creating an account or using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

SalesFortuna is an Amazon PPC automation and optimization platform. The Services are provided as software and include, but are not limited to:

• Automated bid and budget optimization via the Amazon Advertising API
• Campaign performance analytics and reporting
• Keyword and search term analysis
• Negative keyword management and placement optimization
• TACoS-based bidding constraints and automated alerts

SalesFortuna provides software tooling and automation. It does not provide advertising agency services, managed campaigns, or consulting services unless separately agreed in writing.

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services. The Services are intended for business use. By registering, you represent that you are using the Services for commercial purposes.

You must have a valid Amazon Seller Central or Amazon Advertising account to connect to the Services. SalesFortuna does not guarantee eligibility or compatibility with all Amazon account types.

To access the Services, you must register for an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

SalesFortuna is not liable for any loss or damage resulting from unauthorized use of your account when you have failed to adequately protect your credentials.

SalesFortuna offers subscription plans as described on the pricing page. Subscriptions are billed on a recurring basis (monthly or as otherwise stated). Payments are processed via Stripe.

• Variable fee: in addition to the base plan fee, a variable fee of 3% applies to ad sales generated through SalesFortuna above the threshold of your current plan. Organic sales are not counted.
• Invoicing: you will receive an invoice each billing period. Additional invoices are issued when variable fees apply.
• Late payments: overdue payments may result in suspension of your account until the balance is resolved.
• Refunds: fees are generally non-refundable except as required by applicable law or as specifically stated at the time of purchase.

Connected third-party services such as Amazon Advertising and Stripe are subject to their own terms and pricing, which are independent ofSalesFortuna.

SalesFortuna may offer a free trial period for new accounts. During the trial, you have access to the Services at no charge for the stated duration.

• No credit card is required to start a trial unless stated otherwise
• At the end of the trial, access will require a paid subscription to continue
• We reserve the right to modify or discontinue trial offers at any time
• One trial per person or organization; abuse of trial terms may result in suspension

You are responsible for your use of the Services and must ensure that your use complies with all applicable laws and Amazon's policies.

• Provide accurate and complete information when registering and connecting accounts
• Maintain appropriate authorizations for any Amazon accounts you connect
• Promptly notify SalesFortuna if your Amazon account access is revoked or suspended
• Keep your account credentials secure and not share them with unauthorized parties

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Resell, sublicense, or offer the Services as a white-label product without written permission
• Attempt to gain unauthorized access to any systems, networks, or accounts
• Use the Services to violate Amazon's Seller or Advertising policies
• Interfere with the operation, integrity, or performance of the Services
• Introduce malicious code, scripts, or automated bots not authorized by SalesFortuna

We strive to maintain reliable access to the Services. However, we do not guarantee uninterrupted availability. The Services may be temporarily unavailable due to maintenance, updates, infrastructure issues, or factors outside our control.

Availability of certain features depends on your connected Amazon account status and Amazon API availability. SalesFortuna is not responsible for downtime or limitations caused by Amazon's systems.

By connecting your Amazon account, you authorize SalesFortuna to access your Amazon advertising and seller data via the Amazon SP-API and Amazon Advertising API within the scopes you approve.

• You retain ownership of your Amazon data. SalesFortuna processes it solely to deliver the Services as described in our Privacy Policy.
• You are responsible for ensuring your use of SalesFortuna complies with Amazon's usage policies for third-party tools and API access.
• You can disconnect your Amazon account at any time from your SalesFortuna account settings.
• Amazon's own Terms of Service and Privacy Policy govern your relationship with Amazon independently of these Terms.

You may cancel your subscription at any time from your account settings. Access continues until the end of the current billing period.

SalesFortuna may suspend or terminate your access if you violate these Terms, fail to pay amounts due, or if your actions create legal or security risks. We will provide notice where reasonably practicable.

Upon termination, your right to access the Services ends immediately. Outstanding payment obligations survive termination. Data retention upon termination is governed by our Privacy Policy.

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. SalesFortuna does not warrant that the Services will be error-free, uninterrupted, or that specific advertising outcomes will result from use of the platform.

To the fullest extent permitted by law, SalesFortuna's total liability for any claim arising from your use of the Services is limited to the amount you paid to SalesFortuna in the 3 months preceding the claim. SalesFortuna is not liable for any indirect, incidental, consequential, or punitive damages.

You agree to indemnify and hold SalesFortuna harmless from claims, damages, or expenses arising from your violation of these Terms, misuse of the Services, or breach of applicable law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of competent jurisdiction in Delaware.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Services following the posting of changes constitutes acceptance of the revised Terms.
